Dobbs v. Jackson
Could the outcome of the Dobbs v. Jackson Women’s Health Organization Supreme Court Case make abortion illegal in Louisiana?
Yes, if the Supreme Court decides to overturn Roe v. Wade and put the decision to allow abortion into the states’ hands, then abortion would be illegal in the state of Louisiana due to a trigger law we have in place.
Another potential—and perhaps more likely—outcome of the Dobbs v. Jackson case is that Mississippi can continue its 15-week limitation on abortion. If this happens then, because of another trigger law we have in place in Louisiana, we would also have a 15-week ban on abortion. This would be a change from Louisiana’s current 20-week ban.
However, the Supreme Court may decide to reaffirm Roe v. Wade, which would mean that abortion in Louisiana would continue as is (currently illegal past 20 weeks). The Supreme Court may also decide on something else entirely that could affect the legality of abortion in our state.
While we would love to see abortion outlawed completely in Louisiana, we are hopeful that the Dobbs v. Jackson outcome will at least mean further restrictions on abortion with a 15-week ban.
